New Rules on Distraint, Forfeiture and Rights of Re-entry

Soon Part 3 of the Tribunals Courts and Enforcement Act will come into force abolishing the Landlord’s traditional remedy of distraint and replacing it with a new statutory procedure called Commercial Rent Arrears Recovery (CRAR).
This is a fundamental change and could be perceived as strengthening the Tenant’s position and represents the most radical change to the Law of Distraint for a Century.
However, the news for Landlords is not all bad. The introduction of the new procedure gives rise to a number of practical issues for enforcement agents, their Clients and Lawyers.
There are also wide-ranging changes to the law on Forfeiture and Re-entry which are to be replaced
with entirely new statutory procedures.
Legal disputes are inevitable in the Landlord/Tenant relationship. It is essential that you know and understand the relevant rights and responsibilities.
Latimer Hinks and National Enforcement will be holding a presentation on these changes which affect Commercial Landlords and will compare them with the existing regime via case studies.
Andy Coates of National Enforcement Services will speak about the issues bailiffs and Landlords will face once CRAR comes into effect.
Mark Gardner, partner at Latimer Hinks will speak about the existing remedies/rights for Landlords. Both speakers will then work through a case study (with hopefully a little audience participation) to highlight differences.

Therefore it is important for those who distribute IT knowledge to keep up to date with technological advancements to promote social inclusion.
IT in the Community will analyse themes such as the importance of the integration of technology, community engagement, empowerment and capacity building programmes. It will do this by providing sessions and workshops aimed at giving delegates the chance to discuss and debate issues with subject leaders. The first day will end with a networking session, providing an exclusive chance to make useful business contacts and enjoy a selection of drinks and nibbles.
In the business world, technological advancement means we are becoming closer to being a global digital community, therefore companies are able to reach out to a larger audience. Although this is a positive notion, Small to Medium Businesses can often feel overwhelmed. IT in the Community will be held at the Stadium of Light in Sunderland and is providing a free stream of workshops for SMEs on the afternoon of the 25th of November, called IT Works.
IT Works has been set up to inform and educate businesses about creating a Digital Identity and provide information about Sunderland Software City. The opportunity to attend these free workshops will allow delegates to consider the way in which they use technology within their business and the potential of more efficient alternatives. The stream of workshops will culminate with a networking event, allowing delegates to discuss, debate and ponder the points raised over a glass of wine.

David Dunn, Chief Operating Officer of Sunderland Software City, will be outlining the vision for North East England's latest innovation connector: "Sunderland Software City is a new multi-million pound project to establish the software industry in North East England as a major global force. It will increase the number of new and growing software companies based in the region and provide job opportunities both in the industry and in its supply chain."
A recent independent study found that Sunderland has the infrastructure and expertise to deliver the project, and with successful partnership working, Sunderland Software City will have a strong positive influence on the North East's economy.
The session is part of the IT Works programme being staged to inform local businesses of regional IT initiatives, alongside a national conference. The conference will allow delegates to consider the way in which they use technology within their business and the potential of more efficient alternatives. The Deputy Minister for Digital Inclusion, Wayne David will present a keynote speech at the Conference on 25th November; delegates will discuss the use of IT in improving digital equality. Sunderland is the natural home for such a conference as in 2007 the City was the winner of the Governments Digital Challenge competition.
The conference, supported by Sunderland City Council and One North East, is free to attend for companies based in North East England, and provides an opportunity to network and knowledge share with IT professionals from the public and community and voluntary sectors.
